History
US' first law regarding real estate came into force in 1917. It was effected by the California Department of Real Estate. It provided for the regulation and licensing of the real estate agents. It continues to be followed as a standard for similar lawmaking in other states, since its inception. The California Department of Real Estate is the leader in real estate legislation throughout US.
Procedures
The laws and regulations of these departments have been laid down by the Real Estate Law, and the Subdivided Lands Law. There are five district offices in Sacramento, Fresno, Los Angeles, Oakland, and San Diego. The officers, here carry out the duties as par the laws. The Department generates its revenues, via, Real Estate Licenses, Subdivision Public Reports, and Other Permits, issued by the Department. This revenue is used for the functioning of the Department itself.
The Governor appoints the Commissioner. He acts as the chief executive of the Department of Real Estate. It is the duty of the commissioner to help the administration to the best of his abilities. He has to enforce the laws. The Commissioner is empowered by the Real Estate Law, and Subdivided Lands Law to hold meetings regarding a certain licensee. There has to be some proof to back the respective judgment. He is empowered to freeze, annul, or refuse him the permission to use his license. The Commissioner has the power to come out with regulations regarding enforcement and maintenance of laws. He can issue the Desist and Refrain Order that stops people from violating the Real Estate Laws and Subdivided Lands Law. He has to be an impartial administrator fair in his judgment to both individuals and industries. He has to ensure that laws are adhered to in a manner that customer interests are properly taken care of.
